Definitions

Term Meaning
Agreement / Terms These Terms and Conditions and any documents incorporated by reference.
Mylin / we / us / our The provider of the Service described in these Terms (see Contact).
Service / Program / App The Mylin platform, websites, mobile apps, dashboards and related services.
User / you An individual who uses the Service. May include a parent/guardian, a teen (as permitted), or an invited contributor (e.g., teacher, mentor).
Organization A school, club, employer or other entity that procures or provisions access to the Service.
Trusted Circle Persons you or your Organization authorise to contribute or view insights (e.g., parents, teachers, mentors).
User Content Feedback, ratings, life-event entries, notes, messages, profile data, and any other content you or your Trusted Circle submit.
AI Outputs Insights, scores, prediction or other model-generated score for the personality traits produced by the Service from your inputs and settings.
Consumer Health Data Information linked or reasonably linkable to a consumer that identifies mental/behavioral status or trends (e.g., well-being observations and life events), as defined by applicable law.

1. BACKGROUND

  • These Terms and Conditions (the “Terms”) form a legally binding agreement between you and Mylin. They govern your access to and use of the Service. By creating an account, clicking “I agree,” or using the Service, you agree to these Terms.
  • Eligibility. You must be at least 18 to create an account, except that a parent/guardian may create and manage an account for a child under 13, or for a teen 13–17 as permitted by law and the Service. Teen participation may require verified parent/guardian consent. Organization‑managed accounts are subject to the Organization’s direction and the agreement between the Organization and Mylin.
  • If an Organization provides you access, the Organization is responsible for ensuring it has the necessary rights and consents.

2. PURPOSE OF PRODUCT AND HOW IT WORKS

  • The Service helps families and organizations track life events and well‑being, gather structured feedback from a Trusted Circle, and generate AI‑assisted insights and reports. You may invite peers and control what they can see or do. Administrators of Organization accounts may configure and access information per the governing contract.
  • We may provide passive educational content and interactive guidance. AI Outputs are generated from inputs you and your Trusted Circle provide along with optional signals you enable. We may provide de‑identified statistics and usage analytics to improve the Service.

Children: For users under 13 in the U.S., we obtain verifiable parental consent before collecting personal information, unless an exception applies.

3. USE OF SERVICE

  • License. Subject to these Terms, we grant you a limited, personal, revocable, non‑exclusive, non‑transferable, non‑sublicensable license to use the Service for your own non‑commercial purposes (or, for Organization accounts, solely for the Organization’s authorised purposes).
  • Restrictions. You will not (and will not permit anyone else to): (a) copy, modify, translate, or create derivative works of the Service; (b) reverse engineer, decompile, or attempt to extract source code; (c) access the Service to build a competing product; (d) use the Service in unlawful, harmful, or abusive ways; (e) upload content that infringes or violates others’ rights; (f) attempt to bypass security or rate limits; or (g) resell, rent, or lease the Service.
  • Account Security. You are responsible for maintaining the confidentiality of your credentials and for activity on your account. Notify us immediately of unauthorised use.

4. DISCLOSURE AND ASSUMPTION OF RISK

  • Informational Only—Not Medical Advice. The Service and any content or AI Outputs are for well‑being support and educational purposes only. They are not medical, psychological, or legal advice and are not a substitute for professional care.
  • No Emergency Services. The Service is not designed for crisis or emergency use. In an emergency, call local emergency services or appropriate hotlines.
  • Appropriateness. Use of the Service may not be appropriate for all individuals or circumstances. You accept the inherent risks of using well‑being tools and agree to use your judgment and seek professional care when needed.
  • Accuracy. We do not guarantee that AI Outputs or other information are error‑free, complete, or fit for your particular purpose.

5. INFORMATION PROTECTION (PRIVACY; IP; OWNERSHIP; SECURITY)

  • Privacy. Our processing of personal information (including Consumer Health Data) is described in the Mylin Privacy Policy. By using the Service, you acknowledge that we will process data as described there and as necessary to deliver the Service.
  • User Content. You retain ownership of your User Content. You grant Mylin a worldwide, royalty‑free, non‑exclusive license to host, use, reproduce, process, adapt, and display your User Content as necessary to provide and improve the Service, including to generate AI Outputs and to operate features you enable. For Organization accounts, you also grant the Organization rights you authorise via settings or contract.
  • Feedback. If you provide suggestions or ideas, you grant Mylin a perpetual, irrevocable, worldwide license to use them without restriction or compensation.
  • Mylin IP. The Service, including software, models, and content we provide, is owned by Mylin or its licensors and is protected by intellectual property and other laws. No rights are granted except as expressly stated.
  • Security. We use reasonable safeguards to protect information, but no system is 100% secure. You accept the risks inherent in internet connectivity and software.

6. CHILDREN & SCHOOLS

Children under 13 may use the Service only through a parent/guardian account or an Organization acting as an authorised school official, with required consents (e.g., COPPA in the U.S.). Teens 13–17 may participate with appropriate parental consent and controls. For Organization accounts subject to education privacy laws (e.g., FERPA), we act as a service provider/school official under the Organization’s direction.

7. FEES

If you subscribe to paid features, you agree to pay the fees and taxes shown at checkout or in the applicable order. Subscriptions may automatically renew unless you cancel per the instructions provided by us or the app store. For Organization‑provisioned access, fees may be paid by the Organization; your personal use may be free of charge. We may change prices prospectively with notice as required by law.

8. DISCLAIMERS; LIMITATION OF LIABILITY; INDEMNITY

  • Disclaimers. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT AND AI OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON‑INFRINGEMENT, AND QUIET ENJOYMENT.
  • No Special Damages. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, GOODWILL, OR DATA.
  • Cap. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID TO MYLIN FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
  • Basis of Bargain. The exclusions and limitations above form an essential basis of the bargain between you and us and apply even if a remedy fails of its essential purpose.
  • Indemnity. You will indemnify and hold harmless Mylin, its affiliates, and their officers, directors, employees, and agents from any claim, demand, loss, or damage arising from (a) your User Content; (b) your use or misuse of the Service; (c) your violation of law or these Terms; or (d) any dispute with an Organization or member of your Trusted Circle.

9. THIRD‑PARTY SERVICES; APP STORES; TELECOMMUNICATIONS

  • The Service may link to or interoperate with third‑party services. Their terms and privacy policies govern those services, and we are not responsible for them.
  • If you download the mobile app from Apple or Google, your use is also subject to their terms. You acknowledge that Apple/Google are not responsible for providing maintenance or support and that (to the extent permitted) they have no warranty obligations regarding the app.
  • You are responsible for carrier data charges and device compatibility.

10. CHANGES TO THE SERVICE AND TO THESE TERMS

We may update the Service and these Terms from time to time. If we make material changes, we will provide notice as required by law. By continuing to use the Service after changes take effect, you accept the updated Terms.

11. ACCESS, CORRECTION & PORTABILITY OF RECORDS

You may request access to, correction of, or export/portability of certain information via in‑product tools or by contacting us as described in the Privacy Policy. For Organization accounts, we may redirect your request to the Organization when it controls the data.

12. TERMINATION & SUSPENSION

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. Upon termination, sections that by their nature should survive will survive (e.g., IP, disclaimers, limitation of liability, indemnity, governing law).

13. MISCELLANEOUS

  • Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
  • Waiver; Severability. A failure to enforce a provision is not a waiver. If any provision is unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the remainder will remain in effect.
  • Governing Law & Venue. These Terms are governed by the laws of the State of Texas, without regard to conflict‑of‑laws rules. Exclusive jurisdiction and venue lie in the state and federal courts located in Texas, and you consent to personal jurisdiction there.
  • Entire Agreement. These Terms, together with any supplemental policies referenced herein (including the Privacy Policy), constitute the entire agreement between you and Mylin regarding the Service.
  • Notices. We may provide notices by email, in‑product messages, or by posting to the Service. You should keep your contact information current.
  • Force Majeure. We are not responsible for delays or failures due to events beyond our reasonable control.
